These Terms of Service ("Terms") govern your access to and use of the website operated by Lowkey Stock LLC ("Lowkey Stock," "we," "our," or "us"), including all products, services, content, and features made available through www.lowkeystock.com (the "Site").

By accessing our Site or placing an order, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please do not access or use the Site.

1. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to place an order through this Site. By placing an order, you represent and warrant that you satisfy these requirements or have the permission and supervision of a parent or legal guardian.

2. Products

Lowkey Stock LLC specializes in authentic trading cards, sealed trading card products, collectible accessories, memorabilia, apparel, and related merchandise. Because collectibles are subject to manufacturer production methods and market fluctuations, customers acknowledge that:

  • Pack contents are random.
  • Pull rates are determined solely by the manufacturer.
  • We cannot guarantee autographs, relics, numbered cards, inserts, parallels, case hits, or any specific card.
  • We cannot guarantee grading outcomes from PSA, BGS, CGC, SGC, or any grading company.
  • Factory imperfections, including print lines, centering issues, edge wear, surface scratches, roller marks, wrapper defects, seal imperfections, or manufacturing inconsistencies, do not constitute damage for purposes of returns or refunds.

Purchasing sealed products constitutes acceptance of the inherent randomness of collectible products.

3. Product Availability

All products are offered subject to availability. While our inventory is updated regularly, inventory discrepancies may occasionally occur due to synchronization delays, manufacturer shortages, distributor allocation changes, or other unforeseen circumstances.

If an item becomes unavailable after an order has been placed, Lowkey Stock LLC may, at its sole discretion:

  • Issue a full refund.
  • Provide store credit.
  • Offer a comparable replacement product.
  • Partially fulfill the order.

4. Pricing

We reserve the right to modify prices without prior notice. Despite our best efforts, pricing errors may occur. If an item is displayed at an incorrect price due to typographical error, technical malfunction, or system error, we reserve the right to cancel the order and issue a full refund regardless of whether payment has already been processed.

5. Orders

Submission of an order does not constitute acceptance. An order is considered accepted only after payment has been authorized and the order has been prepared for shipment.

Lowkey Stock LLC reserves the right to refuse or cancel any order, including but not limited to situations involving:

  • Suspected fraud.
  • Payment verification issues.
  • Pricing errors.
  • Inventory shortages.
  • Violations of these Terms.
  • Excessive purchase quantities.
  • Suspected reseller abuse.
  • Shipping restrictions.
  • Suspected automated purchasing, including bots.

6. Fraud Prevention

To protect our customers and business, Lowkey Stock LLC reserves the right to:

  • Verify billing information.
  • Request identification.
  • Require signature confirmation.
  • Delay shipment pending verification.
  • Refuse shipment to freight forwarding services.
  • Limit quantities.
  • Refuse future orders.

Any attempt to circumvent purchase limits or engage in fraudulent activity may result in cancellation of orders and permanent restriction from purchasing through our Site.

7. Shipping Risk

Ownership and risk of loss transfer to the customer upon delivery of the package to the shipping carrier, except where prohibited by applicable law. Customers are responsible for providing an accurate shipping address. Lowkey Stock LLC is not responsible for packages delayed, misdelivered, or returned due to incorrect customer information.

8. International Orders

Customers outside the United States are solely responsible for:

  • Customs duties.
  • VAT.
  • GST.
  • Import taxes.
  • Brokerage fees.
  • Customs clearance requirements.
  • Local import restrictions.

Lowkey Stock LLC is not responsible for delays, seizures, or returned shipments caused by customs authorities.

9. Intellectual Property

All content appearing on the Site, including logos, trademarks, trade dress, graphics, images, videos, product photography, website design, software, text, and branding, is the exclusive property of Lowkey Stock LLC or its licensors and is protected by United States and international intellectual property laws. No content may be copied, reproduced, modified, distributed, or used without prior written consent.

10. User Conduct

You agree not to:

  • Violate applicable laws.
  • Interfere with Site operation.
  • Attempt unauthorized access.
  • Use automated purchasing software.
  • Submit false information.
  • Infringe intellectual property rights.
  • Upload malicious code.

We reserve the right to terminate access for violations.

11. Limitation of Liability

To the fullest extent permitted by law, Lowkey Stock LLC shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from the use of this Site or any products purchased through it. Our total liability for any claim shall not exceed the amount actually paid for the applicable order.

Lowkey Stock LLC disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Force Majeure

Lowkey Stock LLC shall not be responsible for delays or failures resulting from circumstances beyond our reasonable control, including but not limited to:

  • Acts of government.
  • Labor disputes.
  • Cyberattacks.
  • Transportation interruptions.
  • Customs delays.
  • Supplier shortages.
  • Pandemics.

14. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of New Jersey, without regard to conflict of law principles. Any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located within the State of New Jersey, unless otherwise required by applicable law.

15. Changes to These Terms

Lowkey Stock LLC may update these Terms at any time. The most current version will always be posted on this Site with the updated effective date. Continued use of the Site following changes constitutes acceptance of the revised Terms.
